Protecting Firearm Owners and their families

Why Does a GUN OWNER NEED A GUN TRUST?

A Gun Trust is an estate plan for your firearms.

1. National Firearms Act (NFA) Compliance

The NFA (26 U.S.C. Chapter 53) imposes strict regulations on certain types of firearms (Title II weapons), including registration, transfer taxes, and background checks. Only the registered owner may lawfully possess or use an NFA item. Unauthorized possession, even temporarily, is a federal felony.

2. Trust Law

A trust is a legal entity that can own property, including firearms. A gun trust is typically a revocable living trust specifically drafted to hold firearms and comply with federal and state law. Trustees and beneficiaries are named, and the trust can continue after the grantor’s death.

3. Estate Planning and Probate

Firearms, especially NFA items, present unique challenges in probate. Transferring such items through a will or intestacy can result in unintentional violations of federal law if the recipient is not eligible or if proper procedures are not followed.

  • Privacy Protection: Unlike individual ownership, a gun trust does not require the disclosure of personal information to the public, maintaining the privacy of the gun owner and beneficiaries.

  • Avoidance of Probate: Firearms held in a trust do not go through probate, allowing for a quicker and more efficient distribution to beneficiaries.

Types of Gun TrusTS

The Bronze Gun Trust is designed for NFA regulated firearms permitted in Colorado. It can be upgraded to a Silver Edition Gun Trust at a later time if necessary.

Bronze

The Silver Gun Trust is built for collectors who want to make sure their firearms—from NFA items to regular rifles, pistols, and shotguns—are handled with care and smart planning.

It helps you keep your collection out of probate and completely private. You can set it up as an individual trust or a joint trust, depending on what fits you best.

Silver

The Gold Gun Trust option is great for anyone with a larger firearm collection or more complex needs—like owning guns in multiple states, planning differently for each beneficiary, or making sure your collection is protected and passed down through generations. It’s all about keeping things secure, simple, and tailored just for your family.

Avoids probate and remains private.
